Bankruptcy Law Frequently Asked Questions (FAQs) | Missouri & Illinois Common Bankruptcy Legal Questions

Q: Can I change from one chapter to another?

A: Generally, yes. There are, however, certain qualifications that you must meet that a bankruptcy attorney helps you with. You have a right to convert from a chapter 13 to a chapter 7 but there are certain dangers that you should discuss with your attorney before taking the plunge. There is not an absolute right to convert from a chapter 7 to a chapter 13. Both can be done but, again, there are many factors to consider first that are important to speak with your attorney about.

This is yet another example of how important it is to have an experienced bankruptcy attorney. A capable bankruptcy attorney will be able to determine what details will change and adjust your case accordingly. While changing from chapter 7 to chapter 13 or vice versa seems fairly simple, a really great bankruptcy lawyer will know which chapter is in your best interest and be able to give you the advice you need to have a successful bankruptcy.

At Castle Law Office, I do a “conversion review.” I look at your case like I would the very first time and make sure it is in your best interest to file. This prevents you from changing into a kind of bankruptcy that won’t help you or change your current situation.
