Q: Does a divorce decree protect me if my ex-spouse files?
A: If you did not cosign any loans with your spouse, you shouldn’t be responsible for the debt. If you have cosigned a loan with your ex, you may be responsible for some of the debt, even if the divorce decree says you are not. Of course, every situation is different and, depending on the terms of your divorce decree, you can be more or less responsible for the debts that your ex-spouse owes. So keep in mind that just because a debt is listed in a divorce decree to be paid by the ex, it does not automatically mean you will be relieved of that debt if the ex defaults on the payment. In most cases, the creditor will still come after you. You should contact an experienced attorney immediately to find out what your options may be.
